Customer understand that this is an ONLINE order. Cakes by Gina LLC will make the cake following the specifics of the order. Cake is sold as it is shown on the website. No modifications to design (colors, textures, number of tiers etc) are allowed.
Customer understands that this ONLINE order does not include a complimentary tasting, or any further assistance other than coordinating the final details for the delivery. Cakes by Gina reserves the right to use different prices for both the online and the In Person orders.
The customer understands that the available ONLINE prices are not available in the store.
Cakes by Gina, LLC is not a florist. If fresh flowers or greenery is required as part of the cake design, the flowers MUST BE in a bucket of water by the cake table when the cake is delivered. Due to the limited amount of time Cakes by Gina, LLC has for cake delivery, all flowers required to finish the cake must be on-site during the delivery. If the flowers are not available at the time the cake is delivered, Cakes by Gina, LLC will not wait for delivery of flowers. If the flowers are placed on the cake by another person who is not a Cakes by Gina, LLC employee, Cakes by Gina, LLC will not be responsible for any damage done to the cake.
Cakes by Gina, LLC’s products may contain or come into contact with dairy, wheat, nuts, soy and other allergens. I agree to notify my guests of this risk and will not hold Cakes by Gina, LLC liable for allergic reactions and will defend, indemnify and hold Cakes by Gina, LLC harmless against any and all claims that may be brought as a result of any allergic reactions to cake ingredients. Cakes by Gina, LLC assumes no responsibility or liability for any personal injury due to any of the ingredients or processes used to make this cake.
Force Majeure: If by reason of act of God or force majeure such as fire, war, earthquake, hurricane or unforeseen weather, strike, lock-out, labor controversy, pandemic (including COVID-19 and all resulting circumstances), civil unrest, interruptions or delays in reasonably available means of transportation, acts of any government or its agencies or officers, or any order, regulation, or ruling thereof, Cakes by Gina, LLC is prevented from making delivery of any order, Cakes by Gina, LLC shall have the right to extend the delivery time for a reasonable period and/or cancel the order at its sole discretion. Notwithstanding any such delay or cancellation, Customer shall remain obligated for the full Contract price if the cake has been prepared (in whole or in part).
